Welcome to Weda.

These Terms of Service (“Terms”) govern your access to and use of the Weda mobile application and related services (“Weda”, the “App”, or the “Service”).

Weda is developed and operated by Asen Mitev under the Mitev Smart Labs brand (“we”, “us”, or “our”).

By creating an account, accessing, or using Weda, you agree to these Terms. If you do not agree with these Terms, please do not use Weda.

1. About Weda

Weda is a weather and clothing recommendation application designed to help users decide what to wear based on factors such as:

Current weather conditions
Feels-like temperature
Future weather conditions
Personal comfort preferences
Clothing preferences
Clothing stored in the user’s Weda wardrobe
Recent outfit recommendations
Other personalization information

Weda may also provide features including weather forecasts, Later Today information, clothing recognition, wardrobe management, notifications, and personalized outfit recommendations.

Weda’s functionality may change and develop over time.

2. Eligibility

You must be legally permitted to use Weda and enter into these Terms under the laws applicable to you.

If you are below the age at which you may independently agree to these Terms or consent to the processing of your personal data, a parent or legal guardian may be required to provide appropriate authorization.

You are responsible for ensuring that your use of Weda complies with applicable laws and regulations.

3. Your Weda Account

Some Weda functionality requires a user account.

When creating and maintaining an account, you agree to provide accurate information and keep your account information reasonably up to date.

You are responsible for maintaining the confidentiality and security of your account credentials.

You must not intentionally allow another person to gain unauthorized access to your account.

4. Weather Information

Weda uses weather information to provide forecasts and clothing recommendations.

Weather information may originate from third-party weather services and may occasionally be:

Delayed
Incomplete
Inaccurate
Unavailable
Different from actual local conditions

Weather can also change unexpectedly.

Weda does not guarantee the accuracy, completeness, or availability of weather information.

For situations involving severe weather, emergencies, travel safety, or other safety-critical decisions, you should consult official weather authorities and appropriate emergency information.

5. Clothing and Outfit Recommendations

Weda generates clothing recommendations using automated software-based logic.

Recommendations may consider information such as:

Temperature
Feels-like temperature
Rain
Wind
Humidity
Future weather
Your wardrobe
Personal comfort preferences
Clothing preferences
Recent recommendations

Weda’s recommendations are intended to provide convenient everyday guidance.

Individual comfort varies, and Weda cannot guarantee that every recommendation will be suitable for every user or circumstance.

You remain responsible for deciding what clothing is appropriate for you and the conditions you encounter.

6. Later Today

Weda may analyze future weather conditions and provide information about changes expected later in the day.

For example, Weda may suggest bringing an umbrella or an additional layer if conditions are expected to change.

Later Today information is based on forecast data and may not accurately predict actual future conditions.

You should use your own judgment when deciding whether to follow a recommendation.

7. Machine-Learning Clothing Recognition

Weda may provide machine-learning functionality that attempts to recognize clothing items from photographs.

Automated clothing recognition may occasionally:

Identify an item incorrectly
Select an incorrect clothing category
Fail to recognize an item
Produce a low-confidence result

You are responsible for reviewing information generated through automated recognition where appropriate.

We do not guarantee that machine-learning recognition will always be accurate.

8. Wardrobe

Weda may allow you to create a digital representation of your wardrobe.

You are responsible for the content and information you add to your wardrobe.

Weda may use your wardrobe information to generate personalized clothing recommendations.

We do not guarantee that wardrobe information will always be available without interruption, and you should not use Weda as the sole permanent storage location for information that is particularly important to you.

9. Notifications

If you enable notifications, Weda may send notifications relating to weather conditions, clothing recommendations, or other Weda functionality.

Notification delivery depends on factors outside Weda’s direct control, including:

Device settings
Operating-system permissions
Network availability
Background execution restrictions
Platform notification services

We do not guarantee that a particular notification will always arrive or arrive at a specific time.

You should not rely on Weda notifications for emergency or safety-critical information.

Notifications can be disabled through Weda or through your device settings.

10. Acceptable Use

You agree not to misuse Weda.

You must not intentionally:

Attempt to gain unauthorized access to Weda, another user’s account, or Weda infrastructure
Circumvent authentication or security mechanisms
Interfere with the operation or security of Weda
Introduce malware or malicious code
Abuse, overload, disrupt, or attack Weda’s infrastructure
Attempt to extract private information belonging to other users
Use Weda for unlawful purposes
Reverse engineer Weda where prohibited by applicable law
Exploit bugs or vulnerabilities to harm Weda or its users
Use automated systems to access Weda in a manner that materially disrupts the Service

Nothing in these Terms restricts rights that cannot legally be restricted under applicable law.

11. Intellectual Property

Weda, including its software, branding, design, graphics, logos, recommendation systems, user interface, and other original materials, is protected by applicable intellectual-property laws.

Unless otherwise stated, the rights in Weda are owned or controlled by Asen Mitev, operating under the Mitev Smart Labs brand, or are used under appropriate licenses.

The names Weda and Mitev Smart Labs, associated branding, logos, and visual identity may not be copied or used in a way that falsely suggests authorization, sponsorship, or affiliation.

Third-party software, libraries, trademarks, data, and services remain the property of their respective owners and may be subject to separate licenses and terms.

12. License to Use Weda

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Weda for its intended purposes.

This license does not transfer ownership of Weda or its intellectual property to you.

You may not sell, sublicense, distribute, or commercially exploit Weda except where expressly permitted by us or by applicable law.

13. Privacy

Your use of Weda is also subject to the Weda Privacy Policy.

The Privacy Policy explains how personal information may be collected, processed, stored, and shared when you use Weda.

A link to the current Privacy Policy should be available through Weda or the relevant Weda website.

14. Third-Party Services

Weda relies on third-party technologies and services to provide some functionality.

These may include services for:

Authentication
Database and cloud infrastructure
Weather information
Application distribution
Operating-system functionality
Other technical infrastructure

Weda currently uses services including Supabase for certain backend functionality.

Your use of third-party platforms may also be subject to their own terms and privacy policies.

We are not responsible for third-party services to the extent permitted by applicable law.

15. Availability of Weda

We aim to keep Weda available and functioning reliably, but continuous availability cannot be guaranteed.

Weda may occasionally be unavailable because of:

Maintenance
Software updates
Technical problems
Internet outages
Third-party service failures
Security incidents
Circumstances outside our reasonable control

We may modify, suspend, or discontinue functionality where reasonably necessary.

Where practical, we will aim to minimize disruption to users.

16. Changes to Weda

Weda is an evolving product.

We may add, modify, replace, or remove features as the application develops.

This may include changes to:

Recommendation functionality
Wardrobe functionality
Weather functionality
Machine-learning functionality
Notifications
User interface
Free and premium functionality

Where a change materially affects your rights or obligations, we will provide notice where required by applicable law.

17. Weda Pro and Future Paid Features

Weda may offer optional premium functionality under Weda Pro or another premium offering.

Premium features may include additional functionality not available in the free version of Weda.

The exact features, pricing, subscription period, and conditions applicable to Weda Pro will be displayed before purchase.

Availability and pricing may vary by country or platform.

18. App Store Purchases and Subscriptions

If Weda Pro or another paid feature is purchased through Apple’s App Store, payment will generally be processed by Apple through your Apple ID.

Applicable purchases and subscriptions may therefore also be subject to Apple’s terms and billing rules.

Where recurring subscriptions are offered:

The price and billing period will be shown before purchase
Payment will be charged through the applicable application marketplace
Subscriptions may automatically renew unless cancelled according to the marketplace’s applicable rules
Subscription management and cancellation may be handled through your Apple ID or applicable marketplace account

Weda does not receive or store your complete payment card details when payment is processed by an application marketplace.

Specific subscription terms will be presented before Weda Pro becomes available for purchase.

19. Future Social Features

Weda may introduce optional social functionality in future versions, including features related to profiles, friends, saved outfits, or sharing outfits.

These features are not necessarily part of the current version of Weda.

If social or user-generated-content functionality is introduced, additional rules may apply regarding:

User-generated content
Privacy
Sharing
Reporting
Blocking
Moderation
Public profiles

These Terms may be updated accordingly before or when such functionality becomes available.

20. Account Suspension or Termination

We may restrict or terminate access to Weda where reasonably necessary, including where a user:

Seriously or repeatedly violates these Terms
Uses Weda unlawfully
Attempts to compromise Weda’s security
Attempts to harm other users or Weda infrastructure
Engages in fraudulent or abusive activity

Where appropriate and legally required, we may provide notice or an opportunity to resolve the issue.

21. Account Deletion

You may delete your Weda account using the account-deletion functionality available within the application, where provided.

Deleting your account may permanently remove information associated with the account.

Account deletion does not necessarily cancel an active App Store subscription automatically.

If you have an active subscription, you may also need to cancel it separately through the applicable application marketplace.

Please review the Weda Privacy Policy for additional information about deletion and retention of personal data.

22. No Medical or Professional Advice

Weda provides weather and clothing information for everyday convenience.

Weda does not provide:

Medical advice
Healthcare advice
Emergency advice
Professional meteorological warnings
Occupational safety advice
Other professional advice

You should not rely on Weda where professional or emergency guidance is required.

23. Disclaimer of Warranties

To the extent permitted by applicable law, Weda is provided on an “as available” basis.

While we aim to provide a reliable and useful service, we do not guarantee that Weda will always:

Be uninterrupted
Be error-free
Produce perfectly accurate recommendations
Contain perfectly accurate weather information
Recognize every clothing item correctly
Be compatible with every device or operating-system version

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

24. Limitation of Liability

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising solely from reliance on Weda’s automated recommendations, weather information, third-party information, or temporary unavailability.

Weda should not be used as the sole source of information for decisions involving health, emergencies, severe weather, personal safety, or other high-risk circumstances.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer-protection rights.

25. Consumer Rights

If you are a consumer in the European Union, European Economic Area, or another jurisdiction with mandatory consumer-protection legislation, you may have legal rights that cannot be waived or limited by these Terms.

Nothing in these Terms is intended to remove or reduce those mandatory rights.

Where these Terms conflict with mandatory consumer-protection law, the applicable mandatory law will prevail.

26. Changes to These Terms

We may update these Terms as Weda develops, when functionality changes, or when legal or regulatory requirements require an update.

When these Terms are changed, the “Last updated” date at the top will be updated.

If changes materially affect your rights or obligations, additional notice or consent may be provided where required by applicable law.

Continued use of Weda following an update may constitute acceptance of the updated Terms where permitted by applicable law.

27. Governing Law

These Terms are governed by the applicable laws of Bulgaria, subject to any mandatory consumer-protection rights or other rights you may have under the laws applicable to your place of residence.

Nothing in these Terms prevents a consumer from relying on mandatory protections available under applicable European Union or national law.

28. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
